Role of Health/Functional Foods within Patent Landscape is Topic of Wellness '09 Presentation

Nerac Analyst Shanon Trueman will present a session titled, "Health/Functional Foods Within the Patent Landscape," at the Wellness '09 Conference in Chicago, March 25-26, 2009.

The presentation addresses opportunities within the intellectual property and product landscape for functional foods and health foods; specifically, opportunities for ingredients within functional foods, indications and diseases treated, and product categories, and is targeted towards R&D scientists, intellectual property experts and marketing and business development professionals.

Some key points to be covered in the presentation include:
1. Europe has the most functional foods on the market; however, the European Patent Office holds comparatively few patents on functional foods.
2. The Japanese Patent Office has received many more applications on functional foods than have other patent offices, and has applications dating back nearly twenty years.
3. Future market potential for functional foods may be in North America, South America, and Asia/Australia.
4. Potential health conditions that may be targeted with new functional food products include diabetes, bone health, and cardiovascular health.
5. Potential functional food categories may include breakfast foods, baby foods, snacks, and desserts.

In addition, Bob Stohrer, Vice President R&D, Stolle Wellness will be co-presenting a session titled "Substantiation of Food and Supplement Claims," during which he will discuss the difference between FDA claims, patent claims, and FTC claims as they relate to functional foods; as well as the review and evaluation processes. And Antony Pavel, Jr. of K&L Gates will be co-presenting "Functional Food and Nutraceuticals: A Regulatory Update". Mr. Pavel will discuss the regulatory background behind functional foods and ingredients, and how a manufacturer can use the claims for marketing a product (including prohibited claims and gray areas).
