All is well and your estate is perfectly in order, right? WRONG.

Traditionally, those documents include a will, durable power of attorney, health care proxy and perhaps a trust. All is well and your estate is perfectly in order, right? WRONG!

Too often the drafting of legal documents is confused with developing an estate plan. Sure, legal documents are part of an estate plan, but they are not “the” estate plan. You need to make sure that you have everything in one spot. If not, you could cause yourself some real problems. That’s why 98% of all estate plans fall short. That’s why you have debacles like the Terry Schiavo case and the Ted Williams dispute. In order to make sure that these sort of things don’t happen to you, you have to have a plan. Most people plan out what should happen in the event of their deaths. What if you are disabled or mentally incapacitated? Effective estate plans must be drafted in order to account for these kinds of contingencies.

If you wish to have an effective estate plan, you must answer four extremely critical questions:

1. What documents do I need?

You need a will, durable power of attorney, and health care proxy. Additionally, you need an original marriage certificate, military discharge paperwork, health and life insurance information, beneficiary designation forms, deeds, and appraisals. Another necessity you need to have is a listing of important contacts with telephone numbers.

2. How will my beneficiaries find these documents?

We all have our own personal and unique filing system that has worked well for us over the years. That’s fine. You should use your own unique filing system, whatever works for you. However, you do need to create a system that “unlocks” your personal filing system. For example, if something ever happened to you, how would your beneficiaries even know you had a safety deposit box, let alone the location of the bank or key?

3. Who should have access to these documents and when?

I know that’s actually two questions camouflaged as one. Remember, these documents are personal and confidential. Today, we are all too aware of the very real threat of identity theft. Safeguarding these documents and making them available, under specific circumstances, to a select group of individuals will allow you to protect your privacy while still preparing an effective estate plan.

4. Who will best advise my beneficiaries?

Your estate plan needs to address not only your financial assets, but also your dreams, wishes, and values. You need to designate that one person who can capture all these characteristics of your life, someone with whom you have shared those most personal thoughts. At you or your beneficiaries’ time of need, who should be that one call?

Don’t confuse proper estate planning with simply drafting the needed documents or purchasing an insurance policy or special investment product. An effective estate plan can only be accomplished with a well thought out approach that is designed to protect your most important information and guide your heirs. Only then will you have peace of mind in knowing that you’ve done your best for your loved ones and nothing important will be overlooked.

A press conference took place at St. John's Riverside Hospital, Yonkers, on May 12 to address proposed rules to cut funds to New York State health care providers, including Medicare cuts to hospice and Medicaid cuts to hospitals.

Kate Colburn, MA, Executive Director of Hospice & Palliative Care of Westchester addressed the audience regarding adverse affects of cuts to hospice funding. Jim Foy, president of St. John's Riverside Hospital; Congresswoman Nita Lowey; Ken Raske, president of the Greater New York Hospital Association; and Joseph O'Brien, Director of Public Affairs for Congressman Eliot L. Engel, addressed the Medicaid cuts.

"The proposed rules will cut more than $11 million in services from hospices in New York State. They will also cut more than $1 million from the five hospices in Westchester and more than $300,000 from my program. These cuts will drastically affect hospice programs which take care of anyone with any life-limiting diagnosis regardless of their ability to pay," Colburn said.

"The purpose of the cuts is to curtail Medicare spending on hospice care by over $2 billion over the next three years. That is $2 billion out of a program whose spending level in 2006 is estimated to be $11 billion," Colburn added.

The Bush Administration's proposed regulatory changes could "cost hospitals in Westchester $28 million in the first year," said Jim Foy, president of St. John's Riverside Hospital.

"We are advocating that a supplemental spending bill moving through Congress includes a moratorium on these proposed regulations, several of which are scheduled to take effect on May 25. If passed, New York's hospitals and health systems could lose $7.4 billion over five years starting on May 25," said Congresswoman Lowey.

"Unfortunately, the health care system, particularly in New York, is facing unprecedented challenges that if unaddressed can threaten the long-term stability of an already fragile system and limit the access and affordability to medical care that every American deserves," Lowey added.

According to the New York State Dept. of Transportation, the number of senior residents in Westchester will increase to 191,000 in 2010. By 2020, it will grow by 37% to 231,000. By then, "we will have to produce 30% more positions in the health care arena. We have to invest now," said Ken Raske, president of the Greater New York Hospital Association.

In remarks delivered for him, Congressman Engel said that we must work hard "to protect our communities from irrevocable harm."

In October 2008, the Food and Drug Administration issued an alert that stated: "Fluoroquinolones, including Levaquin, are associated with an increased risk of tendonitis and tendon rupture in all ages. This risk is further increased in older patients usually over 60 years of age, in patients taking corticosteroid drugs, and in patients with kidney, heart and lung transplants."

The FDA added: "Tendon rupture can occur during or after completion of therapy; cases occurring up to several months after completion of therapy have been reported. Levaquin should be discontinued if the patient experiences pain, swelling, inflammation or rupture of a tendon. Patients should be advised to rest at the first sign of tendonitis or tendon rupture, and to contact their health-care provider regarding changing to a non-quinolone antimicrobial drug."

Levaquin (a brand-name of Levofloxacin) is a powerful antibiotic in a class known as fluroquinones, and is prescribed to treat bacterial infections, most commonly those in the sinus, skin, lungs, or urinary tract. With rare exception, Levaquin is prescribed only to adults, as problems with joints have been observed when used in children.

Tendonitis and Ruptured Tendons
Tendons are the parts of the body that connect muscles to bones, and are essential for proper movement and mobility. Tendonitis (also called tendinitis) refers to the inflammation of a tendon, and is a term used to refer to more-severe injuries to the tendon. Tendonitis can occur in many parts of the body and is extremely painful. Achilles tendinitis of the heel and patellar tendinitis of the knee are common examples.

A ruptured tendon refers to a snapped or torn tendon, which can cause excruciating pain and may result in a permanent disability. Depending on the degree and type of injury, ruptured tendons may be treated with surgery or through immobilization, such as with a cast.

The Health & Safety Executive said that work related stress is in many situations, is the “adverse reaction people have to excessive pressures or other types of demands placed on them”. Stress in the work place is massive and costs industries £3.7 billion per year and furthermore the issue is not going away. The H&SE believes that work related stress is a serious problem for organizations productivity as well as their staff’s health. For that reason alone, it is in employer’s interests to control work related stress, which the law states is their duty to do. With that in mind this is an area that both Richard and Sam will attack with great enthusiasm, aiming to reduce the number of extreme cases which here in the UK currently stand at around 5,000,000 per year. As more Americans discover health savings accounts, the result will be lower costs, greater choice, and higher quality medical care.

As Health Savings Accounts grow in popularity, there is growing fear among those who want to nationalize healthcare that they will not be able to put the cat back in the bag. There are already over 3 million HSA owners, and by 2010, the Treasury Department estimates as many as 45 million Americans will be covered by HSA plans. They will have billions of dollars invested to cover future medical expenses, and by then it will be politically impossible to take that benefit away.

With a high-deductible health insurance plan, money is invested tax-free into a Health Savings Account. There are different types of investments to choose from -- anything from savings accounts or money market funds, to stocks, bonds, and mutual funds. Invested wisely, an account could accumulate over $500,000 by retirement. That money can be used to pay for healthcare, tax free. And best of all, it affords the freedom of choice when paying for healthcare.

If proponents of a single-payer system were to ever have their way, individuals would be at the mercy of a government bureaucrat when it comes to their healthcare. To see what this might look like, all one has to do is look at the state of health care in Canada, England, New Zealand, and the parts of Europe that have not yet abandoned single-payer systems.

Proponents of a single-payer system tend to point to Canada or England as countries that cover all their citizens with quality healthcare, while spending less money per person than the U. S. But if we look a little closer, we see that these publicly financed health insurance systems are breaking down, the quality is low, and the costs can be quite high. Here's what Canadians have to deal with if they need medical care:

Long waits. Hundreds of Canadians go to Detroit and other U. S. cities every year for procedures like CAT scans, which they can obtain treatment in a matter of days. In Canada, the wait is typically six months. Currently 876,000 Canadians are on waiting lists for medical procedures.

Difficulty in getting life-enhancing procedures done. If a Canadian is having a heart attack, they will be treated right then. But if the surgery is considered "elective" (meaning that possible death is not eminent), the wait could be months or years. Average wait for cataract removal is 18 months. Average wait for a knee replacement is one year.

Increased risk of dying. The average Canadian waits eight weeks to see a specialist, and another nine weeks before getting treated. This is even the case with conditions that are likely to get much worse if there is any delay in treatment. For example, the median time for a mastectomy is 14 weeks, enough time for the cancer to spread to other parts of the body. In fact, 28% of those diagnosed with breast cancer in Canada die from it, while the mortality ratio in the U. S. is only 25%.

Things don't look any better across the ocean. Each year the British National Health Service cancels 410,000 surgeries because of resource shortages. According to the London Sunday Times, there are currently over 1 million Brits awaiting elective surgery. Thomas Cook, a British travel agency, is even considering offering "sun-and-surgery" packaged trips to Indian hospitals for British citizens fed up with low standards and long waiting times for surgery.

The British and Canadian governments have the power to make healthcare "free", but they are unable to control its costs. So the costs become longer (and potentially fatal) delays, and fewer innovations.

It's not surprising what is happening. Universal health insurance systems always encourage over-consumption by patients, and such over-consumption always leads to financial crises. The result is inevitably broken promises about universal access and quality care. Because there are always limited resources, single-payer systems tend to overspend on primary care for the healthy, while denying more expensive specialist care to those with serious medical problems. This is because most people (voters) are healthy most of the time, and the sick and dieing are less likely to be able to organize into a political force.

What makes the United States such a great country is the "freedoms" we enjoy. Though our freedoms seem to be constantly under attack, there is still no nation in the world that has the freedom of the press, freedom of religion, freedom of association, or the free markets that we have in the United States. As anyone who understands even a smidgen of economics knows, free markets encourage competition and innovation, which lead to lower prices and better quality.

Though the U. S. system of health care can not really be considered a "free-market", it is certainly much more free than any single payer system. Some of the benefits we see as a result of our current healthcare system include:

U. S. medicine produces the best outcomes for virtually every patient, from premature babies to elderly cancer patients. American companies are the chief source worldwide of new treatments and procedures which each year are used to save millions of lives. U. S. medical training and research facilities are the best in the world.

Though Canadians might have to wait a year or two for hip replacement surgery, they can get the same operation done on their dog in less than a week. This is because veterinarians are competing for that business, finding innovative ways to deliver service more quickly and less expensively. Another example is laser eye surgery, a procedure that is rarely covered by insurance, so laser eye surgeons must compete on the basis of cost and quality. While costs for most medical procedures have been going up every year, the cost for this procedure has dropped by 80% over the past decade.

Unfortunately, U. S. healthcare policies still tend to limit competition, restrict consumer's freedom to choose, and discourage consumers from shopping for value. Thus, there are too few choices and there has been little attention paid to price and quality of service. The answer is clearly not more government intervention, but instead letting competition and the power of the marketplace drive down prices and increase quality and access to care.

Health Savings Accounts are the Solution

There is increasing recognition that third-party health insurance payers are actually a major cause of escalating medical costs and the decline in the quality of service. The increasing adoption of HSA plans has already begun to cause greater transparency and competition in the medical marketplace. There are now physicians available by phone, medical kiosks setting up in malls, doctors that accept only cash (and charge significantly less), and others competing directly for the consumer's healthcare dollar.

Don't be fooled by the politicians who advocate a single-payer system, claiming their only concern is the uninsured. If a single body (such as a government bureaucracy) controls healthcare, they control one seventh of the national economy. And everywhere in the world that central control of the economy has been tried, it has been a colossal failure.

As public policy reforms centered on individual choice continue to gain wider footholds, the result will be greater prosperity, greater choice, and a better value for all. The culture of dependence and entitlement will begin to fade, as millions of individuals demand further policy reforms that will reinstate the values of freedom and personal responsibility that helped establish this great nation.

As more consumers turn to health savings accounts, the market will respond. Innovative providers will begin to compete more on price and quality of service, and those that provide the best value will get wealthy doing so. And all consumers will benefit.

“Depression responds very well to EFT,” he says. “In most cases the depressed feelings vanish or are materially reduced within a few minutes of applying it. No drugs are involved. Also, repeated applications of EFT often eliminate these feelings permanently so that they no longer reappear on a daily, weekly or monthly basis."

According to Craig, most EFT practitioners report an 80-percent success rate in treating depression and other unresolved emotional issues. Its basic premise is that the underlying cause of all negative emotions, including depression, is an energy block in one or more of the body’s meridians, the same energy pathways mapped thousands of years ago by Chinese physicians.

“The combination of tapping and mental focus releases the energy blocks,” he explains, “and the symptoms they cause are released at the same time.”

According to the survey, most consumers visit a coffee shop around once a week, with 70% reporting that they go to coffeehouses or snack restaurants less than five times a month. That came as a surprise considering the popularity of coffee among all types of consumers these days. Many reported that they use time at a coffee or snack restaurant to reflect, or as an escape. That, coupled with the fact that just 4% of consumers reported trying a new coffeehouse or snack restaurant in the last 30 days, indicates big room for growth for chains that can entice consumers in the door.

Playing Favorites
When asked which coffeehouse or snack restaurants were their favorites, Starbucks was cited by 36%, decidedly more than any other restaurant or coffeehouse. Dunkin’ Donuts (28%) and Krispy Kreme (16%) ranked second and third, respectively, followed by Tim Hortons, Caribou Coffee, Seattle’s Best, McCafé, Peet’s Coffee & Tea, and The Coffee Bean and Tea Leaf. However, when the number of locations is factored into the results, Krispy Kreme wins by a mile – earning 35% of the vote. See Graph 2. And, when just coffeehouses are considered (with snack restaurants such as Krispy Kreme removed from the equation), Peet’s Coffee & Tea and Caribou Coffee stand out as favorites. Even though Starbucks seems to be synonymous with coffee, it falls all the way to the bottom of the rankings — just above McCafé — when the results are indexed by number of stores. The chain’s sheer number of locations seemed to dilute all of the votes for Starbucks.

Taste Outweighs All Other Factors
So Krispy Kreme has a cult following—who doesn’t love their doughnuts? But are their doughnuts the reason why the restaurant is so adored by consumers? In a word, yes. It’s all about the quality and taste of the food—especially taste, as the survey uncovered. Krispy Kreme outscored competing coffee shops and snack chains on eight of 10 attributes (attributes included Quality of Food, Taste of Food/Coffee, Speed of Service, Friendly Service, Cleanliness, Atmosphere, Accommodating, Overall Value, Healthy Choices, Green/Sustainability) and was off the charts for taste. All other competitors clustered together with virtually no differentiation. See Graph 3.

Consumers View Coffeehouses as an Escape
Coffeehouses/snack restaurants differ from two other categories that were also examined in this survey – quick-service restaurants (http://www. marketforce. com/industries/qsr-quick-serve-restaurants/) (QSR) and casual dining (http://www. marketforce. com/industries/casual-dining/) establishments. This category is strikingly different from the others on two fronts. First, it had much fewer new trials. Only 4% of consumers said they tried a new national or regional brand in the last 30 days, whereas one in three tried a new QSR during that period. Second, this category had the most consumers who said they visited the establishment because they were seeking some alone time. That has some great implications for marketing around factors such as stress relief, time out and indulgence.

The desire to be with friends was not a hugely popular reason for consumers frequenting coffeehouses, with only 18% citing it. Instead, 42% say they go there when they are pressed for time. Visiting a coffeehouse/snack restaurant appears to be more “all about me.” When consumers need some time alone, are in a hurry, too tired to cook, etc., the coffeehouse/snack restaurant is the immediate answer. See Graph 4.

Coffee Drinkers Stimulated to Try Starbucks
Only 4% of consumers said they tried a new national or regional coffeehouse/snack restaurant in the last 30 days. Of those, 38% are experimenters who said they tried more than one. So which brands fared the best among that group? Here is where Starbucks rose to the top, with more consumers (16%) saying they tried a Starbucks for the first time more than any other coffee or snack shop. It is intriguing that an established brand like Starbucks would still be experiencing so many new trials.

Unlike with QSRs and casual dining establishments, recommendations from friends is less important in driving new trials than driving by the location—perhaps because this category represents that need for alone time for consumers. Traditional advertising drives few trials, and promotions drove about 11%, which is on the order of what was found with QSR and casual dining trials.

The study also found that seven in 10 new trials delivered on their promise. About two-thirds of consumers reported having a “GREAT” experience at a new coffeehouse or snack restaurant. The remaining one third of new trial experiences either were rated either just “OK” or “BAD.” So, the opportunity to delight new customers exists in this category and can make the difference between true growth for a brand and just maintaining the status quo.

The survey was conducted in May and June 2010 among the Market Force network (http://www. marketforce. com/the-shopper-force/) of more than 300,000 independent mystery shoppers and merchandisers – consumers across the country dubbed The Force™. The pool of 4,600 respondents ranged in age from 18 – 72 and reflected a broad spectrum of income levels, with 60% reporting incomes of more than $50,000 a year. Eighty percent work full or part time. Seventy-six percent were women – the primary household consumer purchasers. Half of the participants said they have children at home.

Alena Hennessy is a nationally recognized artist/designer who has been featured in such publications as Dwell, ReadyMade, and Oyster magazine. Her art and designs are a part of more than forty galleries/boutiques across the states and abroad. Alena's work consists of woodland creatures in magical habitats that carry the feeling of quiet simplicity and whimsy.

She received her BFA from Florida State University, along with studies in Florence, Italy and at the Pacific Northwest College of Art. Alena and her husband, Andrew, reside in North Carolina.
