Massachusetts-based Cylinder Recyclers today announced that for the first time, consumers and distributors of acetylene have a way to recycle spent steel acetylene gas cylinders produced both before and after 1985. Acetylene gas cylinders are commonly used for applications such as acetylene torches for welding and cutting.

Unlike other compressed gas containers, Acetylene tanks contain as much as six gallons of acetone in a solid binding medium contained within the cylinder. Cylinders produced before 1985 also contain asbestos within the solid core. In the past, the only choice for acetylene consumers and distributors was to store spent tanks in piles on-site or send them to landfills - acetone and all. Both approaches created health, safety and environmental concerns as well as liability issues that can now be resolved via recycling.

With the new process, consumers have a safer and more sustainable alternative. Acetylene containers of any age can now be handled for recycling using Cylinder Recyclers' environmentally friendly process. For asbestos-free cylinders, the residual acetone is removed from the tank's core and recovered for recycling, as is the metal shell. Darla Johnson, represented by Charles Moore and Sean Simpson of Simpson & Moore, LLP was awarded $15.4 million dollars in damages by a jury after a five-week trial in the San Diego Superior Court. (Case #GIE018815). Darla Johnson filed suit against Prudential Insurance for the unlawful termination of benefits under Ms. Johnson's disability insurance policy.

As a project manager in the University of California San Francisco's construction department, Ms. Johnson bought into a group plan providing coverage for income replacement if she became unable to work. In May 1995, Ms Johnson was diagnosed with Lupus, Fibromyalgia Syndrome, Chronic Fatigue Syndrome, and Antiphospholipid Antibody Syndrome, and had to stop working.

After approximately five years of paying benefits, Prudential terminated Ms. Johnson's benefits. Two internal appeals were denied, and Ms. Johnson had to file suit to correct the wrongful termination of her policy benefits.

With no benefits and a life changing disability, Mrs. Johnson took Prudential Insurance to court on the basis that they had wrongly terminated her policy. Prudential maintained that Mrs. Johnson's benefits were properly terminate because Ms. Johnson was unable to provide sufficient objective evidence to substantiate her disability.

The jury in the San Diego Superior Court found Prudential Insurance guilty in wrong fully terminating Mrs. Johnson's policy. The jury awarded Ms. Johnson back benefits and future benefits totaling $982,082.00, plus general damages of $500,000.00 for the grief, humiliation and inconvenience caused by the improper termination of benefits and $14,000,000 in punitive damages.

"We feel our client has been vindicated by this verdict. This case is a landmark victory for anyone with Lupus, Fibromyalia Syndrome, Chronic Fatigure Syndrome, or other illness or syndrome for which there is limited objective medical evidence," Charles Moore of Simpson & Moore, LLP explained.

Other syndromes with similar uncertainty of diagnosis include Carpal Tunnel Syndrome, Gulf War Syndrome, and Auto-Immune Deficiency Syndrome.

"It's my sincere hope that this verdict will be a stepping stone for others to come forward who have had their insurance benefits wrongfully terminated. Hopefully, now people will know they can fight back, and don't have to bow down to the powers of the big insurance companies." Sean Simpson of Simpson & Moore, LLP noted.

The defense attorney for Prudential Insurance plans to appeal the verdict.

The BigHand Speech Recognition module, which utilizes a Dragon NaturallySpeaking™ speech server from Nuance Communications, includes both a "Speech Recognition only" option, where the Transcription Server sends the resulting text back to the author, as well as a "Speech Recognition with proofing" option where the Transcription Server sends the resulting text to a secretary. The secretary performs any corrections, saves the document and then submits a copy of the corrected document. Once submitted the server-based speech file of the original author is upgraded, improving their results going forward. The author can still correct their own speech file if so desired.

Moving the correction of the speech file to the secretary completely removes the time burden from the author and enables no change to their current working practices. As a result, even though there is minimal training, the author's speech file continues to improve over time. In testing the Transcription Server returned a 233 word initial recording with 178 words correctly recognized (76.4%). After the first correction, the transcription server improved to recognise 226 of the words (97%), and by the third submission the Server based system recognised 232 words (99.6%).

The overall total cost of ownership of the new back-end Speech Recognition module is estimated to be as little as one third the cost of existing digital dictation systems with client-side Speech Recognition integrations. The module is licensed per user or per server, with minimal training required, no client-side installation and, subsequently, no loss of billable time. Additional features include Citrix & Terminal Services compatibility, document templates & bookmarks, acoustic modeling, vocabularies configured in BigHand System Administration, default and custom speaker profiles for different users of BigHand, and support for distributed Transcription Servers.

2009 Revolutions Award for Outstanding Nonprofit Leader to Christina Lennon, Executive Director of the Georgia Lions Lighthouse Foundation, for her work in providing vision and hearing services through education, detection, prevention and treatment for Georgians. During her three-year term at the Georgia Lions Lighthouse Foundation, she has taken the 57-year-old organization strained by increasing demand and a diminishing donor base and turned it around by establishing robust relationships with foundations and by re-vamping programs. These efforts have resulted in an increase of providing eye exams and eyeglasses from 400 to 4,000 people a year, decreasing costs from $100 per pair of eyeglasses to $25 per pair, and doubling the number of surgeries.

2009 Revolutions Award for Outstanding Nonprofit Organization to Skyland Trail for promoting recovery from mental illness and fostering reintegration into the community, while empowering adults to live with dignity and independence. Before Skyland Trail opened its doors in 1989, Georgians with mental illnesses faced a void as they tried to bridge the gap between hospitalization and returning to community life. Skyland Trail is unique to Atlanta with its holistic approach of providing residential communities and individualized treatment programs including 'recovery communities' support systems comprised of 10 to 15 clients with similar diagnoses and its full-time on-site primary healthcare clinic. 2009 Revolutions Emerging Philanthropist Award to Usher Raymond IV, Chairman and Founder of Usher's New Look, for his leadership in reaching youth from diverse socio-economic backgrounds and providing them a chance to learn about the business side of the entertainment industry. In the past four years, New Look has mentored over 1,300 disadvantaged youth from across the country through Camp New Look. In addition Usher launched the "I Can't But You Can" voter registration campaign geared towards youth ages 17 and under where participants completed educational curriculum on the voting process before going out into the community to register first-time voters. How can this be? How can anyone lose that sort of weight in that number of days? It sounds too good to be true. It is however some of the claims being made in a concept of weight management that is as different as it is profound.

Overeating conjures up images of plates full of food and those behind them tucking in to this mountain of food. This is not the case. The term simply applies to the wrong type of food stuff (protein, carbohydrates, fats) been eaten by the person.

Let's explain a little bit further. The human body will only use a percentage of the food that you eat. The rest, if it absorbs it, it stores By the way the body is very efficient at absorbing digested food. Less than 5% is not absorbed from a healthy person.

It stores it to use at a later date. Here the vicious circle comes about. People get hungry again, so they eat. If they are not active the body stores it again. As canbe clearly seen this brings about a cycle of despair.

If the body absorbs food how does it use it? Without going into too much science of it the body is governed by something called a “Metabolic rate”. What this means is simply the rate that the bodies reactions work. These reactions result in growth, production of energy and elimination of waste.

This process gets its fuel from what get's put in our mouths. It takes what it needs and keeps the rest.

This metabolic rate varies from person to person. There are however ways in which this can be altered. The first is the most obvious, exercise.

Exercise is an essential part of being a human being. Like it or not the human being is an animal. Probably the most inactive animal at that. Yet like the rest of nature this animal is supposed to be active. Not all of us are athletes but we can all walk. That is enough just a few times a week to help raise activity level.

The other way of altering your metabolic rate is less obvious, but just as profound. The very stuff that we put in our mouths can do it for you.

Yes certain types of food are rich in the very things that govern the metabolic rate. Certain vitamins and minerals when in abundance actually do help the body to break down food more efficiently.

Some foods are even said to have a negative calorie content. Now we know that this is nonsense. How can something have less than zero of anything, if it did it would not exist? To clearly understand what this means is that if say an orange has 100 calories but to digest it took 115 calories then it would have 15 negative calories.

An interesting concept in itself as whilst studying Biology the teacher mentioned Celery has having exactly these properties. A fibrous water filled plant that we humans could not digest properly but our bodies would try to and fail. Hence spending more energy doing so than we got from it.

So as has been seen it is possible to be active and eat proper food to raise our natural fat burning machine that is the human metabolic rate. As a result no diet should be ridiculed. In fact diets are only rubbished by others trying to promote the latest fad or trendy diet and those losing business try to damage it to keep business.

There are a very large number of people interested in weight management and they should find the diet that is going to suit them. A diet is a personal thing and it is the aim of this article to highlight that to those reading it. Also to let them know that with a bit of research the goals that they set are attainable.

U. S. companies of all sizes must be in compliance with the privacy regulations of the Health Insurance Portability and Accountability Act (HIPAA) by April 14, 2004, and HR professionals should be on the alert, says G. Neil Corp.

“If your company offers healthcare benefits, whether your plan is self-insured or fully insured, or if you come into contact with employees’ health information for any employment purpose, then you need to be aware of HIPAA,” says G. Neil employment law attorney Ashley Kaplan.

How HIPAA Affects Employers

Even though employers are technically not defined as “covered entities” subject to the HIPAA privacy regulations, the law has a significant impact on employers, Kaplan explained. For example, employers may perform “covered” functions if they obtain and use protected health information to administer their own health plan, or are involved in making or reviewing benefit decisions as a plan sponsor.

The HIPAA privacy laws also affect the way employers obtain and use employee health information to make employment decisions, Kaplan noted: “Employers can no longer obtain protected health information from a covered entity (such as an employee’s doctor) to make employment decisions unless the employee has signed a HIPAA-compliant authorization form.”

Employment decisions potentially affected by this requirement include hiring and firing based on drug test results, determining whether to grant an employee’s request for medical leave, assessing requests for “accommodation” under the Americans with Disabilities Act, and administering fitness-for-duty examinations for job placement and safety.

Penalties for HIPAA Noncompliance

The U. S. Department of Health and Human Services (HHS), through its Office of Civil Rights (OCR), investigates claims of HIPAA violations and can impose civil penalties against individuals and companies. These range from $100 for each violation up to $25,000 for multiple violations of the same standard in a calendar year. “These can quickly add up,” Kaplan said, “if a company repeats the same violation with respect to multiple employees and multiple incidents.”

Individuals who knowingly violate the HIPAA Privacy Rule and willfully misuse employee medical information can be fined up to $250,000 and be imprisoned for up to 10 years, she added.

“If you come into contact with HIPAA-protected health information to administer benefits or to make employment decisions, you need to review your practices to ensure compliance as soon as possible,” Kaplan advised. “Failure to do so could be costly.

“Between now and April 14th, you need to get all of your HIPAA questions answered.”

Categorizing these drugs as "smart drugs" seems to be both an oxymoron and a brilliant marketing ploy, exploiting American's drive to be at the top of their game.

So, if walking far exceeds the brain boosting abilities of these drugs, why aren't more American's changing their behavior? Bordley offers a few explanations. "Most people are unaware how powerful daily walking is for their health. If they were given the information it would change their priorities and motivations. Second, most adults are stressed for time already and and are strapped in a desk and a car for most of their day. Walking 3-6 hours a day is simply out of the question. The third reason is the lack of motivation at the end of an exhausting workday to get out and move."

Treadmill desks offer a solution to these challenges. Employees walk while they work at very slow speeds without sweating. At the end of the day they will have walked between 3-8 hours and gained energy and brain enhancing benefits naturally without pills and without any additional time burden.
