"Starting from today, as explained by President Obama on January 9, 2010, every doctor and patient can now appeal every denied or delayed claim, with prompt pay enforcement and hefty federal penalties from IRS in $100 per day per patient for any violation of new federal external appeal procedures", explained by Dr. Zhou.

According to Dr. Zhou, very importantly, new federal appeals laws provide a process of two-step "prompt pay" enforcement with hefty federal penalties. First step, a pre-service claim (a claim requires precertification) must be decided in 15 days, and a post-service claim must be decided in 30 days, as prescribed by ERISA claim regulation, the minimum requirements of the new federal claims and appeals regulations. In case of a failure by a plan to strictly comply in making a timely payment or decision, the second step is triggered for external appeals. In six business day, a plan must notify claimant of its decision for external appeals. In absence of strict compliance with ERISA and PPACA, an external appeal decision is binding and final. The plan must make immediate payment or a decision to cover requested services, regardless if a plan will appeal or prevail in a court in the future. A failure to comply with new federal external appeal laws will result in a hefty excise tax penalty in $100 per day per patient. In addition, new federal law prohibits any imposition of precertification or prior authorization for all urgent care claims and guarantees coverage for urgent care claims from both out-of-network and in-network providers. PPACA prohibits any discrimination against any provider regardless of participation in managed care network with respect to reimbursement and appeal rights.

Dr. Zhou further explained that new federal claims and appeals regulations will affect every health care claims outside Medicare, including insurance benefits verification, claim submissions, eligibility for providers, pre-certification, policy coverage and limitation, medical necessity, UCR, bundling and down-coding, overpayment demand and recoupment, urgent care, pre-existing conditions, and any claim payment less than 100% as submitted. PPACA, sec. 2706 of PHS Act, specifically prohibits any discrimination against any health care providers regardless of any network participation.

An analytic study by OCI found that over 4% of all workers’ comp claims have a duplicate bill sent to a group health plan.

An analytic study by OCI found that over 4% of all workers’ comp claims have a duplicate bill sent to a group health plan. OCI conducted the analyses on a large employer from their proprietary Reference Database on duplicate workers’ compensation and healthcare payments. The purpose of the study was to determine how frequently and how much greater costs occur if and when providers are billing both workers’ comp and healthcare for the same services, patient or claimant.

The results of the study were presented at a recent meeting of the Fraud Assessment Commission, under the California Department of Insurance Fraud Program. The study found the following:
4.2% of ALL workers’ comp claims have a duplicate healthcare claim Over half of the duplicate claims filed received payment The employer paid over $1.2 million dollars in duplicate payments One-third of the duplicate claims filed were paid more than what was billed The employer paid over $100,000 in overpayments on duplicate claims

“There is an occurrence of duplicate billing on the exact same workers’ comp claim, same date of service, same ICD-9, same billing codes, same provider also billing to group health,” says Archie Anderson, President of OCI. “This was an aged claim analysis, meaning all the payments have been made. This particular employer was not even aware.”

The cause of duplication cannot be determined from the data, however the claim set is easily identified for follow up. To prevent duplicate claims, an employer or organization must commit to integrating its workers’ comp and healthcare billing and claims data to identify where the duplicate billing and payments occur.

A young New Yorker is taking on the NYC marathon to raise awareness and funds for the Society for Women and AIDS in Africa (SWAA).

Every November, thousands of people gather in New York City to partake in one of the most grueling (self-inflicted) physical undertakings known to mankind: the marathon. Each runner has his or her own personal story: some are running the race against all odds; others have been tackling adversity their entire lives. But no matter what the circumstances, each story is almost always inspirational.

For one native New Yorker running the marathon next month, her personal story is not all that compelling. An ordinary young woman of good health, modest means and a predilection to run, her greatest challenge is to find enough time to train while maintaining a small business.

Her personal challenge is not important. In fact letÂ’s just call her Madame X. The story here is not about her, but her motivating factor to finish the race on November 7th: Madame X is running the marathon to raise awareness and funds for the Society for Women and AIDS in Africa (SWAA).

In 1988, several key African women leaders met at the 4th International AIDS Conference in Stockholm, Sweden and accurately predicted that HIV/AIDS would most severely impact women on their continent. It was at that moment that the seeds for the creation of SWAA were planted.

Today SWAA is the only pan-African AIDS organization working with and for women and their families based on locally determined needs and priorities. SWAA mobilizes communities by strengthening capacity to prevent, control and mitigate the impact of the epidemic. Today, SWAA is a network of thirty-nine grassroots country offices.

However difficult the 26 mile trek is going be for Madame X, nothing could compare to the struggle millions of women face every day in numerous countries across Africa. An estimated 14 million children are living today who have lost one or both parents due to AIDS. Elderly grandmothers are without funds or support to look after these orphaned grandchildren. Even those women who, against all odds, are living with the disease are unable to access anti-retrovirals (ARVs) and other necessary health care in order to both better and prolong their lives.

SWAA activities at the national and international levels respond to this call to action. Madame X hopes that you will join her in helping SWAA in their efforts to eradicate AIDS, one mile at a time.

As each day unfolds, the news from New Orleans and the Gulf Coast seems to get more and more grim. As adults, we are all too familiar with unanswered questions about unspeakable tragedies in uncertain times: why? what if? But for many, the toughest questions come from children. Should you talk to your child about this tragedy or should you try to shelter them?

Leading parenting expert Dr. Michael Popkin says that it is imperative that parents do begin a dialogue with their children when a tragedy occurs. According to Dr. Popkin, “All too often, young children sometimes believe that mysterious events like tornadoes and hurricanes are punishments for having been bad. It is imperative that parents gently correct them and explain that nature – or God, if you prefer – has a way of operating that we do not always understand.”

Dr. Popkin adds that the most important thing is to talk to your children and try, no matter how difficult, to answer their questions. “Particularly in times of tragedy, it is important that you reassure your children as much as possible that we have the strength and ability to protect them from harm. Keeping as normal a routine as possible is also important. Focus on the positives – acts of heroism, patriotism, and leadership – that come out of these situations. These can provide lessons that are invaluable. Take time to talk with your kids about values and courage.”

Dr. Popkin also suggests that parents form a type of informal support group with other parents. Talk to other parents about their fears, concerns and how to establish reasonable rules.

Should your children be allowed to watch the news? According to Dr. Popkin, "Because young children are particularly sensitive to images, try to avoid letting kids under the age of six see media reports of violent tragedies like the twin tower collapse on 9/11 or Hurricane Katrina. If they do see something, be sure to talk with them about what happened in language that lets them know that they are safe and that people are being helped. With older children, it is positive for them to watch and discuss what happened. It gives you a chance to strengthen your own values in them." One guideline Dr. Popkin offers is to be aware of what your child is watching. Keep computers, televisions and other media in a public part of the house so you can see what your child is watching.

Finally, Dr. Popkin also suggests that parents talk to children about safety, not just in times of crisis, and be aware of how cautious their children naturally are: “Some kids have a natural cautiousness about them, while others blindly rush in where angels fear to tread. Watch for your child’s tendencies, knowing that with more adventurous children, you will have to do more talking and be eternally vigilant. However, even with cautious children, they do not have the experience to known where danger may be lurking or how to handle it once confronted. The challenge is to teach your children to be reasonably cautious without scaring them into an unhealthy fear of people or new places.”

Dr. Michael Popkin has appeared on over 200 television shows including The Oprah Winfrey Show, Montel Williams, and as a regular parenting expert on CNN. Dr. Popkin is best known as a pioneer in the field of video-based parent education.
